The ambiguous mystery behind the current use and effects of Kratom still fuels the ongoing safety debate and to whether it should remain legal in the United States. For the most part, except for the states of Indiana, Tennessee, Louisiana, Wisconsin, Vermont and Illinois where the sale to minors is prohibited, the herbal substance remains legal in the United States.

Kratom, scientifically known as Mitragyna speciosa, is used for its pleasing opiate effect though it contains no opiates at all. However, the active ingredient in Kratom does bind with the mu-opioid, kappa-opioid, and serotonin receptors just as any opiate would do producing a stimulating anti-depressant and euphoric effect.

In a January 2013 publication the DEA stated that even though Kratom is used as an opiate substitute, long term use produces the same side-effects as the substances Kratom was invoked to replace. Those side-effects included dependency, withdrawals, anorexia, skin darkening, emotional and physical dysfunction, insomnia, and forms of psychosis.
In February 2014, the FDA issued an alert to its field personnel responsible for imports stating they could detain any products containing Mitragyna speciosa without physical inspection. Further, the FDA stated it had determined the substance to depict adverse health effects and qualified as an untested new dietary ingredient.
Though this FDA alert banned the import of any Kratom substance used for consumption, it does not ban its import as a legitimate botanical product. After filing a complaint in the U. S. District Court for the Central District of California labeling Kratom as a misbranded and unapproved drug, it authorized U.S. Marshalls to seize over 25,000 pounds of raw Kratom worth over $5 million from a company in Van Nuys, California.
The legality of Kratom in the United States is still an ongoing concern for lawmakers, those who protect our health, and for advocates on both sides of the fence.
